Terms and Conditions
1. OBJECT
These General Sales Conditions aim to regulate the offer and distance selling of Hydrup products through the website https://www.drinkhydrup.com (hereinafter, "the Website"), to individuals acting as consumers (hereinafter, "the Customers") in Spain.
The offer and sale of Products are carried out through the present website by CITY TIME BRANDS, S.L.U. (hereinafter "CITY TIME"), registered at Avenida Doctor Severo Ochoa, nº47, 1ºB, CP 28100 - Alcobendas (Spain), with NIF number B-87080370, and registered in the Madrid Mercantile Registry under Volume 17510, Folio 32, Section 8, Page M-300778.
Hereafter, for the purposes of these Terms and Conditions, CITY TIME will also be referred to as Hydrup. The products marketed by Hydrup through the present website will be referred to as “the product,” “the products,” “Hydrup product,” or “Hydrup products.”
The Hydrup products offered through the website will be available for the Spanish territory, covering the Iberian Peninsula and the Balearic Islands, excluding the Canary Islands and the cities of Ceuta and Melilla. Orders will also be shipped to a number of European countries.
Customers may contact us for any questions, suggestions, or complaints through one of the following means:

- Calling the phone number 91 309 98 00 during business hours from 8 a.m. to 4 p.m. Monday to Friday. The cost of the call will be the local rate from a landline.
The pre-contractual, contractual, and post-contractual relationship established remotely between Hydrup and Customers is governed by these General Sales Conditions, as well as by the Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, by Law 34/2002 of July 11 on Information Society Services and Electronic Commerce, and any other provisions that are mandatory for business relationships with consumers.
Placing an order by the Customer implies full and unconditional acceptance of these General Sales Conditions, which must be read and accepted each time an order is placed. These conditions may be printed, stored, and reproduced by Customers.
These General Sales Conditions are written in Spanish, the language in which the contract between Hydrup and Customers will be formalized.
Hydrup reserves the right to modify, at any time and without prior notice, the content of the General Sales Conditions. However, such modifications will only apply to sales formalized after the entry into force of the modified General Sales Conditions.
These General Sales Conditions only apply to consumers, as defined in Royal Legislative Decree 1/2007, of November 16, which approves the General Law for the Defense of Consumers and Users.
2. PRODUCTS
All products offered through the Website are displayed in detail in each section of the Website for each category. By entering the "product sheet" of each model, you will be able to see the product's characteristics.
Hydrup makes every effort to ensure that all products offered on the Website are available and that only products that are in stock are displayed. However, it is possible that some products may not be available at the time of placing the order. If this happens, the Customer will be informed of this circumstance when placing the order, as described in section 5 "ORDER CONFIRMATION" of these General Sales Conditions.
The price of the products shown is the price at which Hydrup offers its products through the Website. This price includes all applicable taxes.
3. PURCHASE PROCEDURE
Through the Website:
To place an order, the Customer must access the website www.hydrup.com.
Once on the Website, the Customer can select the products they wish to purchase. To do this, they must click on the "Add to cart" button and indicate the number of units they wish to add. By default, one unit of the product will be added.
Once the Customer has added all the products they wish to purchase, they must access the "Cart," where all the selected products will be displayed. The Customer may remove any products from the Cart if they wish. To proceed with the purchase, the Customer must click the "Proceed to checkout" button, accept the General Sales Conditions, Privacy Policy, and Legal Notice, and provide the requested data related to the order, billing, shipping, and payment.
Failure to provide any required data will prevent the order from being processed. Once the Customer has provided all the required data, they will see a summary of the order, including shipping costs (if any), with a request to confirm these General Sales Conditions and the Privacy Policy.
Once everything has been verified, the Customer must check the box "Proceed to payment," thus consenting for Hydrup to charge the amount indicated in the order, provided that the selected products are available at the time of ordering.
Once Hydrup receives confirmation of the payment, it will send an order confirmation email to the Customer. Additionally, the Customer can track their order using the tracking number provided by Correos Express.
4. PAYMENT METHODS
The Customer may pay the total amount of the order, including shipping costs if any, using debit or credit cards (VISA, VISA ELECTRÓN, MASTERCARD, MAESTRO, or AMERICAN EXPRESS issued by a Spanish bank), or PayPal.
Payment for your order is made in real-time through the Virtual POS once the provided details have been verified.
Hydrup guarantees the secure and confidential handling of the payment details provided. The data for the payment card used is transmitted in encrypted form via SSL. This solution ensures secure communication using encryption keys. To detect and prevent fraudulent operations and avoid unnecessary inconvenience to our Customers, Hydrup has adopted fraud prevention measures and controls. These controls involve analyzing the characteristics of orders and comparing them with previous fraudulent transactions.
Occasionally, to ensure that the transaction is not fraudulent, Hydrup may require you to complete certain information or provide additional details. Refusal to provide this information will prevent Hydrup from verifying the authenticity of the order. In such cases, Hydrup has the right to cancel the order due to fraud concerns.
Despite our efforts to improve fraud detection systems, we cannot fully guarantee that a legitimate transaction may not be classified as fraudulent. If the Customer is affected and a transaction is incorrectly denied, please contact us using the contact methods provided in these General Sales Conditions so we can resolve the issue promptly.
Additionally, the providers or issuers of the payment methods used may have other fraud prevention measures that Hydrup does not control and may result in the rejection of certain types of transactions. Hydrup is not responsible for any damages that may result from the application of policies adopted by different payment providers or issuers.
If paying via PayPal, the purchase amount will be charged to the PayPal account immediately. If the purchase is made by bank card, once the transaction is confirmed by the bank, we will confirm the order by sending a confirmation email. If the bank rejects the payment, the order will be automatically canceled, and the Customer will be informed by email.
If a Customer is charged fraudulently or incorrectly for a purchase made using their payment card number, they may request the immediate cancellation of the charge by sending an email. In this case, Hydrup will refund the amount incorrectly or fraudulently charged as soon as possible.
However, if the purchase was indeed made by the Customer who requests the cancellation, the Customer must compensate Hydrup for any damages caused by the cancellation.
By accepting these General Sales Conditions, Customers who place an order through the Website consent to receive the invoice electronically for the orders placed. Invoices related to Customer orders will be sent by email. The Customer may revoke their consent to receive the invoice electronically and opt to receive a paper invoice by requesting it from the customer service department, calling 91 309 98 00 during business hours from 8 a.m. to 4 p.m. Monday to Friday, or by sending an email to info@hydrup.com. Once the products are delivered to the shipping company, for those Customers who have consented to receive the invoice electronically, Hydrup will issue an online invoice that indicates the product amount, shipping costs (if applicable), and VAT separately. The information provided by the Customer will be used to issue the invoice, and the data cannot be modified once the invoice has been issued.
5. ORDER CONFIRMATION
The order sent by the Customer when clicking on the "Proceed to payment" button is considered a contractual offer and implies full knowledge and acceptance of these General Sales Conditions.
The sales contract between Hydrup and the Customer is considered concluded once Hydrup sends the order confirmation to the Customer's email address. This confirmation will be sent within a maximum of 24 hours.
In this order confirmation email, the order number will be indicated, which the Customer must use in any communication with Hydrup related to the order. The message will include, in addition to the legally required information, all the details the Customer has entered. The Customer agrees to check the accuracy of this data and to notify Hydrup of any necessary changes in a timely manner. Any fees or issues arising from errors in the data that were not corrected in time will be the sole responsibility of the Customer. If payment for the order is not made through the selected payment method, the transaction will be considered as not completed, and Hydrup will not process the corresponding order.
It is possible that one or more of the products included in the Customer's order may not be available at the time the order is processed. In such cases, Hydrup will notify the Customer of the unavailability of the product(s). If the order contains only the unavailable product(s), Hydrup will cancel the order.
6. SHIPPING AND DELIVERY
Shipping costs will be free for all orders within Spain, regardless of the purchase price. For orders to other European Union countries, shipping will be free if the purchase price exceeds €39.
Hydrup will process and ship your order within 24 hours on business days. You will receive a tracking number via email to verify the status of your order. If you do not receive this information, you can contact us through Facebook, Instagram, or by sending an email to info@hydrup.com.
Standard free shipping takes 3 to 7 business days. Please note that the estimated delivery times are approximate and may vary due to factors beyond Hydrup’s control and the shipping company. In any case, the delivery time will not exceed 30 calendar days from the order confirmation.
Taxes and duties: Your order may be subject to import duties and taxes, which are applied once the shipment reaches your country. Customers who place an order in our European store and with a European delivery address will not be subject to import duties, as the products will be shipped from our European warehouse.
We ask Customers to verify, at the time of delivery by the carrier, that:
- The product(s) are not damaged or altered.
- The number of items delivered matches the number indicated on the shipping document.
If, at the time of delivery, you detect that the products are damaged or altered, or that the products do not match the order, we kindly ask you to make the relevant observations and file any justified claims, or even refuse the order if necessary.
According to Consumer Law, delivery to the Customer or to a third party designated by the Customer, other than the carrier, implies the transfer of risk. Consequently, any deterioration, loss, or theft that may occur from that moment will not be the responsibility of Hydrup.
In the event that Hydrup, through the shipping company, has not delivered within the indicated time frame, the Customer will notify Hydrup to fulfill the delivery within an additional reasonable period. If delivery is still not made within this additional period, the Customer will have the right to cancel the contract. The above will not apply if Hydrup had refused to deliver the goods or if the Customer had informed Hydrup before the contract was concluded that delivery was essential by a specific date.
Delivery will be made through the shipping company. The delivery schedule will be Monday to Friday (business days) from 9 a.m. to 7 p.m. Deliveries are not made on Saturdays, Sundays, or public holidays at the delivery location.
At the time of delivery, the Customer will not have to pay any fees to the carrier, as the shipping costs (if any) will have already been paid by the Customer when placing the order.
Hydrup will send a shipping confirmation email to the Customer when the order leaves the warehouse, followed by a tracking number (with a link to the shipping company's website), and finally, the carrier will contact you for delivery.
If delivery is not possible due to the carrier's inability to deliver the order, the order will remain available for the Customer to collect within fifteen days at the office indicated by the carrier. If the Customer does not collect the order within that period, Hydrup will cancel the contract due to impossibility of fulfillment, proceeding to refund the amounts paid by the Customer, although the Customer will be responsible for the return shipping costs and any storage fees that may have been charged to Hydrup by the carrier for holding the order. Without prejudice to the cancellation of the order, the Customer may proceed to place the same order again if they so wish.
7. PROMOTIONS
Occasionally, various promotional offers may be announced on the Website, such as discounts or free gift offers.
Such promotions will be subject to the specific conditions expressly indicated for each promotion, as well as these General Sales Conditions in all respects not contradictory to the promotion's particular conditions.
In the case of a promotion offering a free gift (e.g., when purchasing a specific product, the Customer receives another product as a gift), it must be noted that for any sale with a gift, the return of the purchased product that entitled the Customer to receive the gift will entail the obligation to return the gift as well.
If the Customer does not return the gift, the value of the gift, as indicated in the promotion's specific advertising, will be deducted from the final refund amount.
The gifts or premiums offered cannot be sold or transferred to third parties to obtain direct or indirect profit in any form, nor with the aim of promoting oneself. The Customer may renounce the gift but will not be entitled to any compensation for renouncing it.
8. RIGHT OF WITHDRAWAL (RETURNS)
The Customer will have the right to withdraw from the contract within 30 calendar days (hereinafter "withdrawal period") without indicating any reason, from the date on which the Customer or a third party designated by the Customer, other than the carrier, takes possession of the product. However, the Customer may not exercise the right of withdrawal in the cases provided for by Article 103 of the Consumer Law, including, but not limited to, the supply of goods made according to consumer specifications or clearly personalized.
All returns must be made through the online store, and under no circumstances will exchanges or returns be accepted at Hydrup physical sales points.
In the case that the Customer places an order with two or more products, and these are not delivered in the same delivery, the withdrawal period will begin from the day the Customer or a third party designated by the Customer, other than the carrier, takes possession of the last of the products.
This is without prejudice to the 30-day withdrawal right the Customer has contractually, counted from the Shipping Confirmation received for each of the goods that may be delivered separately in the case of Mixed Orders.
To exercise the right of withdrawal, we recommend that the Customer sends an email to info@drinkhydrup.com within the withdrawal period, communicating their intention to withdraw from the contract.
